President Donald Trump says he has heard rumors about the possible retirement of Justice Anthony M. Kennedy, but doesn’t have any special knowledge about the justice’s plans.
In an interview with the Washington Times, Trump said he would choose a replacement from the same list of 21 potential nominees used to choose Justice Neil Gorsuch.
“It’s a great list,” Trump told the Washington Times. “And I was proud to say it was my idea.”
However, CNN reports that sources close to the nomination process say some former Kennedy clerks could also be under consideration. Possibilities include Judge Brett Kavanaugh of the U.S. Court of Appeals for the District of Columbia and former Solicitor General Paul Clement.
According to CNN, friends and associates believe Kennedy, 80, is seriously considering retirement. Says CNN, “The question appears not to be whether Kennedy will retire soon, but when—at the end of this June, or next?”
Kennedy declined to respond to CNN’s questions about his retirement plans.
