Amazon Class Actions
As all monopolies face eventually, the plague of Class Actions.
The first successful class action on Amazon was settled around 2009 in the Booklocker V. Amazon class action. As soon as Bob Izard won his right to have Amazon in a Federal Court in a class action lawsuit over the POD business (Print on Demand), the retail giant quickly settled the case.
A recent class action has Amazon Marketplace sellers alleging Amazon is violating Washington State Money Transmitter Laws and Amazon has a license in Washington state and most states in the United States as a money transmitter. Amazon admits to having money trasmitter licenses in almost every state.
The thrust of the action is the law is clear, money transmitters must pay merchants within 10 days or they are violating state laws, in this case in Washington State and the applicable law statute is The applicable LAW in Washington State is RCW 19.230.330 (Revised Code of Washington State).
The Amazon Marketplace Seller class action cites RCW 19.230.330 as legal grounds to form a class of Amazon sellers that often have to wait 90 days for Amazon to pay them monies that Amazon owes them as 3rd party sellers.
Amazon also is in yet another class action over not paying wages to employees in their product fulfillment centers.
Now a new class action is being formed by a Judge who is also an author and founder of a publisher and he claims Amazon has harmed every author and publisher on Amazon that has Kindle Editions of their books.
The Judge claims the 90 or so days that Amazon takes to pay authors and publishers is an intentional CRIMINAL VIOLATION of RCW 19.230.330 and he is advising all authors and publishers to file criminal complaints on CEO Jeff Bezos and Amazon the Washington’s state AGO division for consumer protection since Amazon is in his opinion a major criminal enterprise. He says Amazon and Jeff Bezos are also now subject to strict RICO charges and advises all authors and publishers to report Amazon and Jeff Bezos to the US AGO.
